1. eLBC Direct, Inc. will provide the Member with a U.S.A street address for
his/her exclusive use in San Francisco, California, U.S.A.
2. Use of mailbox is activated immediately.
eLBC Direct, Inc. services consist of receiving the Member's mail and or
merchandise and forwarding to the Member's country and delivering it to the
Member based on specified instructions.
Members will be responsible for any charges generated directly from this
activity, such as taxes, customs duties and service fees presently in effect or
established in the future.
3. The eLBC Direct, Inc. Member agrees to obey
all applicable laws and regulations in effect in both the U.S.A. and his/her
country. The Member will be solely responsible for any penalties or fines
resulting from a violation of this condition.
4. Screening of all packages is required to
comply with regulations for safe air and/or sea transport. eLBC Direct, Inc.
will open the package when it arrives from the vendor and we will re-seal and
then ship the package in its original packaging. If the item looks OBVIOUSLY
damaged upon delivery to the Member’s US address, eLBC will not accept the
package and inform Member of non-receipt of the item requested for shipping.
Also, Electronic items or appliances are shipped
at Member’s risk. eLBC Direct, Inc. does not assume liability for damages
incurred in shipping these items.
eLBC Direct, Inc. will have the option to return
all correspondence and packages to the senders at Member's expense or to
forward all such correspondence to the Member at the non-Member shipping rates
in effect at the time.
5. The following General Regulations and
Restrictions shall apply governing a Member’s Air and/or Sea Cargo shipment:
Restricted or Prohibited Items -
Prohibited items are generally those not allowed be to be brought into the
country except when given permission under highly controlled conditions as
provided for in the laws prohibiting them. The following is a sample of items
that cannot be shipped to the Philippines (See Prohibited Item List for more
details):

Gunpowder, Firearms and Ammunition

Narcotics, opium, and opium smoking paraphernalia

Large electronics and appliances
Commercial Quantity – eLBC Direct, Inc. cannot
ship any items of the same kind in commercial quantities. Quantity of the same
kind greater than 12 is considered commercial quantity.
Taxable Items – In general,
unless exempted by law, all articles imported into the Philippines, are subject
to Customs duty and internal revenue taxes and whether subject to duty or not,
shall be entered through a customhouse at a port of entry, where Customs
examination, tariff classification and appraisal are made.
Personal effects that have been used by or obtained by shipper while living
abroad and that have been in use for at least 6 months are acceptable for
importation and may qualify for duty and tax exemption depending on the
importers status and residency.
Personal effects are subject to physical examination by RP Customs. There are
no value limitations on the goods being imported but duties and taxes may be
assessed if the amount of goods presented as personal effects is excessive.
In addition, electronic items or appliances are considered taxable. In order to
simplify our process in calculating additional taxes, please see the
Electronic/Appliance Price Schedule.
Declared Value and Insurance -
Declared Value stated on the Shipping Request Form determines the maximum
liability in case of loss or damage to a shipment. eLBC Direct, Inc. will
provide a Member with automatic insurance of up to $100 ( US) per shipment,
free of charge. Additional comprehensive insurance on merchandise shipments
will be automatically added at US$5.00 for every US$100 of its value. eLBC
Direct, Inc. will insure the merchandise up to a maximum of $500.
Shipping Request Form
The shipper must use and completely fill out the Shipping Request Form
to itemize the contents of the package. The Shipping Request Form is a very
important document because this will allow a Member and/or consignee to easily
check if every item sent is accounted for once the Member’s package arrives at
its destination. It must have the complete Member and/or consignee information
including address and phone number as well as the item description and its
quantity.
Tracking Number – The Member shall be provided with a Tracking
Number that will allow him/her to track the shipment.
Freight Rates and Charges

Freight – Delivery fees are based on the actual shipping size of the package:

Insurance – eLBC Direct, Inc. will provide an automatic insurance of up to $100
( US) per shipment, free of charge. Additional comprehensive insurance on
merchandise shipments will be automatically added at $5.00 US increments for
every $100 US of its value. eLBC Direct, Inc. will insure the merchandise up to
a maximum of $500. (See Insurance Schedule)

Mode of Payment – Shipping and handling charges will apply to
each shipment and are payable by Member in US$ via credit card
To facilitate Credit Card Payments, eLBC Direct, Inc. needs to have the
following: Card Number, Expiration date, Cardholder Name and Cardholder’s
Signature.
Member Acknowledgement
The Member signifies and confirms that he/she understands and agrees with all
the applicable laws, regulations and conditions set forth by eLBC Direct, Inc.
concerning the shipment.
Delivery Commitment
eLBC Direct, Inc.’s delivery commitment is based on the departure date of the
vessel and not at time the items arrive at the US address.
Claim Process
eLBC Direct, Inc. and its courier are not liable for damages or losses for
items not listed on the packing list and is not liable for damages incurred by
shipping perishable or breakable items. This includes items such as used
electronic equipment, dented canned goods, cooking oil in plastic containers,
shampoo, conditioners, chocolate syrup, etc. that are improperly packed.
For Damage or Shortage – The Member must submit a written notice of claim
within 30 days from delivery date of shipment. Claims submitted after 30 days
cannot be processed.
For Non Delivery - The Member must submit a written notice of claim within 90
days from date of shipment. Claims submitted after 90 days cannot be processed.
All claims must be made in writing to eLBC Direct, Inc., LBC Hangar, General
Aviation Center, Domestic Airport Compound, Domestic Road, Rasay City,
Philippines.
Termination
Either party may cancel this agreement upon a minimum of thirty days written
notice or email notice.
